PERSONAL DATA AND GDPD

The Customer is informed of the regulations concerning marketing communication, the law of 21 June 2014 for confidence in the Digital Economy, the Data Protection Act of 06 August 2004 as well as the General Data Protection Regulation (RGPD: No. 2016-679).

1 Persons responsible for the collection of Personal Data

For Personal Data collected as part of the creation of the personal account of the User and its navigation on the Site, the person responsible for processing Personal Data is: EFFICIALE. https://www.efficiale.fr is represented by M BEAULIEU, its legal representative.

As the person responsible for the processing of data it collects, https://www.efficiale.fr undertakes to comply with the legal provisions in force. In particular, it is up to the Customer to establish the purposes of its data processing, to provide its prospects and customers, starting from the collection of their consents, with complete information on the processing of their personal data and to maintain a register of the processing in conformity with the reality. Whenever https://www.efficiale.fr processes Personal Data, https://www.efficiale.fr takes all reasonable steps to ensure that the Personal Data is accurate and relevant to the purposes for which https://www.efficiale.fr processes it.

2 Purpose of data collected

https://www.efficiale.fr is likely to process all or part of the data:

• To enable browsing on the Site and the management and traceability of services ordered by the user: connection and usage data of the Site, billing, order history, etc.

3 Right of access, rectification and opposition

• Right to limit the processing of Users’ data (Article 18 GDPR)
• Right to object to the processing of Users’ data (Article 21 RGPD)
• Right to the portability of data provided by Users, where such data are subject to automated processing based on their consent or on a contract (Article 20 RGPD)
• Right to define the fate of Users’ data after their death and to choose to whom https://www.efficiale.fr should communicate (or not) their data to a third party they have previously designated
• As soon as https://www.efficiale.fr has knowledge of the death of a User or instructions from him, https://www.efficiale.fr undertakes to destroy his data, except if their conservation proves necessary for evidential purposes or to meet a legal obligation.

4 Non-disclosure of personal data

However, https://www.efficiale.fr remains free to choose its technical and commercial subcontractors provided that they present sufficient guarantees with regard to the requirements of the General Data Protection Regulation (RGPD: n° 2016-679).

However, if an incident impacting the integrity or confidentiality of the Customer’s Information is brought to the attention of https://www.efficiale.fr, the latter must inform the Customer as soon as possible and communicate the corrective measures taken. In addition https://www.efficiale.fr does not collect any “sensitive data”.
The Personal Data of the User can be treated by subsidiaries of https://www.efficiale.fr and subcontractors (service providers), exclusively in order to achieve the purposes of the present policy.

Within the limits of their respective attributions and for the purposes recalled above, the main persons likely to have access to the data of the Users of https://www.efficiale.fr are mainly the staff of our customer service.

5 Types of data collected

7. Governing Law and Jurisdiction.

Any dispute in connection with the use of the https://www.efficiale.fr website is subject to French law. Except in cases where the law does not allow it, exclusive jurisdiction is given to the competent courts of PARIS.
